Introduction

These terms and conditions relate to goods which you offer to purchase from the Macsamillion online store (this website).  Please read the terms and conditions, which governs your use of this website and our supply to you of any goods which you offer to purchase through our online store.  We will be unable to process any offer to purchase unless you have done so.  If there is anything you don?t understand please feel free to email us on info@macsamillion.co.uk  By making an offer to purchase, you agree to be bound by the whole provisions of the Agreement between you and us, if you don?t accept the provisions you should not place an order.

You must be 16 years or older to register for the services.  By clicking on the ?confirm order? you confirm to us that you are 16 years or older.

We may change these terms and conditions at any time and we are not under any obligation to notify you of such change.

All contracts shall be governed by and constructed in accordance with English law and any dispute between us will be resolved exclusively in the courts of England and Wales.  Nothing in these terms and conditions will be deemed to affect your statutory rights.

By using this site you are agreeing to these terms and conditions.

Titles

Title in Goods supplies by Macsamillion.co.uk shall pass to the buyer upon payment of the purchase price in full.  We are Macsamillion Ltd, The Limes, Oxford Road, Grove, Wantage, Oxon OX12 7PE.  You are the Buyer detailed on the Order forms.

Our Agreement to supply the goods is made on the date we deduct payment from your credit card the details of which you provided on the Order form.

Our Agreement includes all correspondence from us to you and the descriptions of the Goods as provided by us on our Website or otherwise.

Colour and Style Representations

Computer monitors and scanners vary in their reproduction.  Though we strive for accuracy, all pictures and colours, products displayed should be regarded as approximations.

Price

All prices are listed in Pounds Sterling (GBP).  For international orders, your payment card provider will take payment in your local currency at the prevailing exchange rate.

Orders are subject to acceptance by the company and to availability of goods and will be charged at the prices ruling at the time of acceptance.  Delivery costs will be those as quoted at the time of acceptance of the order unless subsequently agreed by the customer.

The price of the Goods shall be the price quoted by us on our website on the order Summary Page, unless agreed otherwise in writing.  We reserve the right to amend any typographical clerical error or omission to prices where reasonable to do so.  The price is inclusive of any payable VAT in the UK and postage and packing detailed once delivery services has been chosen.

Our Price Promise

If you should find the same shoe at a better price elsewhere, we'd like to know about it and will offer you the same price less 5%. This will not include, items found on Ebay, sale items or those included in a promotional offer and must be exactly the same style, colour and size. Price matches can only be made against UK based companies. Macsamillion reserves the right to refuse any price promise request and may adjust the conditions of the promise at any time.

Promotions and offers

  • 10% off your first order is only applied to non-sale items and may not be active during promotion/sale periods.
  • Extended Sale periods can cease at any time
  • Certain Styles, Brands, colours and size options may be excluded during sale periods


Delivering the order

For the U.K., Europe, U.S.A and BFPO our preferred carrier is DHL*.  As soon as your order has been despatched, you will receive a tracking reference and be able to track your order via the DHL website.

*Remote location postal areas maybe sent via CollectPlus or Royal Mail

Easy Returns and exchanges

We hope you will be pleased with your purchase from Macsamillion, but if you?re unsatisfied for any reason, we have a 30 day returns policy.

Here?s what to do ?

  • Please note, we do not cover the cost of postage for any returns, unless the goods were faulty or the wrong goods sent to you. If the goods were faulty in any way, or we sent the wrong goods to you, you will be refunded the full cost of postage. 
  • All goods must be returned in a new and unused condition.
  • Complete the returns form (this should be with your invoice, if not, a copy can be downloaded here returns form) clearly stating your reasons for return.
  • Pack the goods carefully in their original box, including all original paperwork, with a secure outer wrapper and post to :-

Returns Option 1

Using Collect Plus you can print a returns label online and drop your parcel at a collection point convenient to you. Often their rates are better than the post office, particularly for parcels weighing more than 2kilos.

Returns Option  2

Take your parcel along to the post office and request a certificate of postage. We recommend Royal Mail recorded delivery service if in the U.K.  

Your refund will be completed once your parcel is received by us. Please note that for orders of less than ?50 we do not reimburse the cost of postage associated with delivery to you.  For all orders of ?50 or more a full refund is applied.



Bank Holidays

Orders that go in to processing on a Friday will be dispatched on the Tuesday after a bank holiday on a Next Day delivery service.

Important - if returning goods from the U.S. or non EU countries

Please DO NOT USE COURIER SERVICES such as UPS or FEDEX as there will be excessive clearance fees; we will either refuse delivery or charge the fees back to you. Use standard postal services. You must write "RETURNING UNSUITABLE GOODS TO SENDER" on the customs form and on the outside of the parcel as we will not accept parcels that incur duty charges. You must also tick the ?RETURNED GOODS? box on the customs declaration documents. If this box is not ticked we will recover the costs from you or return the shoes to you.

We are happy to deliver to BFPO addresses using our usual UK delivery methods and couriers.

Please note, however, that we are only responsible for delivery to the BFPO depot in the UK. Movement of goods between there and your location is the responsibility of the BFPO and we are not liable for losses after this point.
Certain BFPO addresses are eligible for VAT free sales.

We do, however, require that VAT is paid with your order and, if applicable, we shall then refund this.

Please ensure when processing your order, the BPFO address where you are based is entered correctly and United Kingdom is selected as your country. The BPFO Commercial Mail will return parcels to us that do not have the correct details. Orders that are returned to us because of incorrect details will incur a delivery cost.
BFPO outside EU

If your BFPO address is outside the EU, your VAT is eligible for refund and this refund will be processed upon our checking the details of your BFPO address against the British Forces list at http://www.bfpo.mod.uk/bfponumbers_static.htm

BFPO inside the EU
Certain BFPO locations within the EU are eligible for VAT free sales.

Before we can issue a VAT refund for an order dispatched to a BFPO address which is within the EU, UK VAT legislation requires us to obtain a "certificate of entitlement" confirming that the items have been shipped to and received by a qualifying body or person as set out in paragraph 14.2 of HM Revenue and Customs Notice 725 dated December 2009.

We can accept a copy of the order receipt which was dispatched with the item(s), signed and stamped by the head or acting head of the embassy, high commission, consulate, visiting force contingent or international organisation, with evidence of the official status of the signatory.
For goods which are shipped to BFPO customers in Cyprus or Germany, we require a certificate from the person placing the order uniquely identifying the supply for which relief is claimed, and claiming entitlement as follows:

- for British forces in Cyprus - under Article 14(1)(g) of EC Council Directive 77/388/EEC, or

- for a visiting force in Germany - under Article 15(10) of EC Council Directive 77/388/EEC.

We require this certificate in accordance with Section 14 of HM Revenue and Customs Notice 725 dated December 2009. If this certificate is not supplied, we cannot make a refund.

* Customs and TAX

Please note that orders from the U.S.A. and NON-EU countries have 20% tax deducted at source when you select the country of delivery on our site. Customers may incur some small Duty or Tax payment on delivery depending on your country's import laws. (This is not the responsibility of Macsamillion). DPD or Customs will contact you prior to delivery to advise you of the charge. Please ensure you have provided the correct contact information when completing your order.

In the event of replacements or repairs being sent to non- EU countries NO duty is normally charged at the receiving end.

Returning goods from the U.S.

In the event that we are unable to supply your goods within the given time, we will inform you immediately and advise you of the expected delivery date. Outstanding orders / items can be cancelled at any time. In the event of any goods delivered by us being damaged in transit, deficient of items shown on the delivery note or failing to match the items ordered by you, then such details must be notified by you to us within seven working days of receipt.


Making Your Order

You need to search our website for the goods you desire to purchase using your Internet browser and our navigation menu system.  Once you have selected the appropriate product(s), complete the Order Form in full and follow instructions detailed on the Website to complete your payment.



Order Fulfilment

You understand that we make every possible effort to update the website to accurately reflect our stock levels.  However, in circumstances where you have ordered an item that is out of stock at the point of picking, your order will be automatically ?Backordered?, while we order new stock or await supply.  In these circumstances our Customer services Team will be happy to present you Tawithoptions.  If your goods are out of stock and discontinued so that we are unable to source the goods, we will make every effort to offer an alternative if possible.  If these alternatives are not acceptable, you may cancel your order at any time.

If your chosen products are in stock your Order will be processed as quickly as is reasonable to do so.  We will deduct the price payable for your chosen products and delivery services from your nominated credit card and your chosen products will be dispatched forthwith.

You understand we aim to deliver instock items to UK customers within 2-5 days but this is not always possible due to reasons outside of our control.  Should UK customers not receive their chosen products within 5 to 7 days of us confirming their availability to you, please contact us and let us know.  You will then be given a choice of:

Cancelling your order whereupon we will refund the price you paid or

Waiting a further agreed time period after which your chosen products have not been received the previous option will be available to you.

Correspondence

Macsamillion.co.uk provides an internet-based service.  Therefore electronic mail(e-mail) is a fundamental part of our service and we are not obliged to accept orders where a valid e-mail address is not provided.  Our primary method of communication regarding your order will be via e-mail.  You understand that we endeavour to manage the e-mails we receive as effectively and as efficiently as we can during normal working hours.  Our online shopping system should ensure that you receive an automated e-mail receipt confirming your registration, your order and any amendments or adjustments that are subsequently made.  You should also receive and automated e-mail receipt confirming your order has been picked, packed and despatched from our depot and that we have subsequently taken payment.  In the event of cancellations, refunds or part-refunds you will also receive confirmatory e-mails.

You understand that we make every reasonable effort to contact you by e-mail in circumstances that are reasonably require us to do so.  You undertake to enter a valid e-mail address and to check e-mails frequently until your order is completed to your satisfaction so that you are aware of any notifications that may be necessary to provide.  The e-mail we send as part of your overall order service is one HTML e-mail sent  offering relevant products and discount information.  You can automatically unsubscribe from receiving further discounts by following the instructions at the bottom of the e-mail.

Cancellation

It is your right to cancel your order within 7 working days of receiving the Goods.  If the cancellation comes about because the goods are not suitable or do not fit then you will need to pay the cost of the return postage .  You are entitled to a refund or exchange in those circumstances.  If the goods are faulty or not exactly as described then you have a right to request a refund of the return postage as well as a refund or an exchange of the goods.  Macsamillion reserve the right to cancel the order at any time.

Ownership of Goods

 All items supplied to the customer remain the property of Macsamillion until final payment of all sums owing in respect of those goods has been received in full by us.

We will collect and store any personal data that you may volunteer whilst using our services, e g. Placing an order, joining our e-mail entering a prize draw or competition.  You can opt out of this at any time by e-mailing or writing to us.
